The Supreme Court of India, in Munshiram vs. State of Rajasthan and Another Etc., has held that it cannot agree with the reasons provided under the impugned judgment concerning certain factual assertions made by the Respondents as to the condition of the deceased and reasons for committing suicide because acceptance of the said would not be in consonance with the settled jurisprudence under Section 482 of Code 1973. The Supreme Court of India, in Bhupendra Kumar Chimanbhai Kachiya Patel and Others vs. Divisional Controller, GSRTC, NADIAD and Others, has held that there is no basis for the employees to claim the benefit from the date of their initial appointment as “Badali Kamdar”. The Madras High Court, in Chennai Container Terminal Private Limited, Mumbai – 400 001 and its Chennai office at No.1, Rajaji Salai, Chennai – 600 001, has held that in setting aside the impugned Award, the learned Single Bench, sat in an appeal over the Award, re-analysed the evidence and adopted the minority interpretation out of two plausible interpretations of Article 3.09 of the contract.
